Carter v. Gordy

On February 3, 2025, Alabama inmate John Carter filed a 42 U.S.C. § 1983 suit against Correctional Officer Michael Gordy. Carter, designated "INMATE 3" in internal records, alleged that during a cell extraction at Limestone Correctional Facility, Gordy twisted his arm and slammed him to the concrete floor without provocation, causing a distal radius fracture. Carter claimed the force was retaliation for prior grievances about food quality. Prison officials countered that Carter refused a direct order and lunged at the officer, justifying a takedown maneuver. Partially obscured surveillance footage failed to resolve the conflicting narratives. The district court evaluated the claim under the Eighth Amendment’s cruel and unusual punishment standard, applying the objective and subjective components from Hudson v. The district court denied Officer Gordy’s motion for summary judgment, finding genuine issues of material fact about the necessity and proportionality of the force. The case proceeded to discovery and is scheduled for a jury trial in late 2025.
